Adeguamento al Regolamento Europeo 2016/679: General Data Protection Regulation (GDPR) 

FINALITÀ E MODALITÀ DEL TRATTAMENTO DEI DATI PERSONALI

I dati personali forniti dall’interessato (“Dati”) saranno trattati per le seguenti finalità:

a. elaborazione, fatturazione ed eventuale consegna di ordini, effettuati in forma digitale e/o cartacea, di prodotti e servizi dell’Azienda.

b. previo consenso dell’interessato, invio di comunicazioni commerciali e/o promozionali sui prodotti e servizi dell’Azienda, ivi inclusi ad esempio inviti ad eventi, presentazioni, mostre e fiere.

c. previo consenso dell’interessato, invio in forma cartacea presso il domicilio o altro indirizzo concordato, di una copia cartacea di cataloghi, listini e newsletter Brumm.

Il trattamento dei Dati per ciascuna delle finalità di cui sopra potrà avvenire con modalità cartacee, automatizzate o elettroniche e, in particolare, a mezzo posta ordinaria, corriere, posta elettronica, telefono, fax e qualsiasi altro canale informatico (ad esempio siti web, mobile app, etc. ).

CONSEGUENZE DELL’EVENTUALE MANCATO CONFERIMENTO DEI CONSENSI

Il trattamento di cui alla lettera a) è basato sull’articolo 6, comma 1 lettera b) del Regolamento (UE) 2016/679. Il conferimento dei consensi di cui alle lettere b) e c) di cui sopra è facoltativo; il mancato conferimento di tali consensi comporterà l’impossibilità di svolgere le attività di cui alle lettere b) e c) da parte dell’Azienda.

ALTRI SOGGETTI CHE POSSONO TRATTARE I DATI

I dati potranno essere trattati da soggetti operanti per conto della Società ed in forza di specifici vincoli contrattuali, senza trasferimento in paesi terzi. I Dati potranno essere comunicati a terzi per adempiere ad obblighi di legge, per rispettare ordini provenienti da pubbliche autorità o per esercitare un diritto dell’Azienda in sede giudiziaria.

CONSERVAZIONE DEI DATI

I Dati trattati per fornire i servizi saranno conservati dall’Azienda per il periodo ritenuto strettamente necessario a conseguire tali finalità. Inoltre, i Dati trattati per fornire i servizi, potranno essere conservati per un periodo superiore, al fine di poter gestire eventuali contestazioni legate alla fornitura dei servizi. I Dati trattati per finalità di Marketing saranno conservati dall’Azienda dal momento in cui l’interessato ha fornito il proprio consenso fino a che tale consenso non sarà revocato. Nel caso in cui il consenso venisse revocato, i Dati non potranno più essere trattati per le citate finalità di Marketing ma potrebbero essere ancora conservati al fine di gestire eventuali contestazioni e/o contenziosi e/o per garantire la sicurezza del Cliente. Il tempo di conservazione dei Dati per finalità di Marketing previsto dall’Azienda è conforme alle norme locali nonché ai provvedimenti dell’Autorità Garante per la Protezione dei Dati Personali.

DIRITTI DELL’INTERESSATO

Come previsto dall’art. 13 del Regolamento (UE) 2016/679, le ricordiamo che l’interessato ha il diritto di richiedere a Brumm snc l'accesso ai suoi dati personali, la rettifica, la cancellazione degli stessi (laddove applicabile), la loro portabilità o la limitazione del trattamento. Ha altresì il diritto di revocare l’autorizzazione al trattamento dei dati per cui ha espresso il consenso, nonché il diritto di proporre reclamo alla Autorità Garante per la Protezione dei Dati Personali. Adaptation to the 2016/679 European Regulation: General Data Protection Regulation  (GDPR) 

PURPOSES AND METHODS OF PROCESSING PERSONAL DATA

The personal data provided by the data subject (the "data”) will be processed for the following purposes:

a. to processing, invoicing and eventual delivery of orders, in paper or electronic format, of products and services.

b. subject to the consent of the data subject, to send commercial and/or promotional communications about products and services offered by the company and associated companies, included for example invitations to events, presentations, exhibitions and fairs.

c. subject to the consent of the data subject, send a free copy Brumm catalogues, pricelists and newsletters to the home address or other agreed address.

The processing of data for each of the aforementioned purposes may be carried out using paper-based, automated or electronic means, in particular via ordinary mail, courier service, by email, via telephone, via fax and via any other IT channel (e.g. websites, mobile apps etc.).

CONSEQUENCES OF FAILURE TO PROVIDE CONSENT

The processing as referred to in letter a) is based on the article 6, subsection 1 letter b) of European Regulation 2016/679. The provision of consent as referred to in letters b) e c) above is optional; however, failure to provide the consent will lead to the impossibility for the company to carry out the activities referred to in letters b) e c).

OTHER PARTIES WHO MAY PROCESS THE DATA

The data may be processed by parties operating on behalf of the company in line with specific contractual obligations, without transfer to third countries. The data may be disclosed to third parties in order to comply with legal obligations or orders from public authority bodies, or to allow the company to exercise its rights in court.

STORAGE OF PERSONAL DATA

The data processed in order to provide the services will be kept by the company for the period considered strictly necessary to achieve these ends. Furthermore, the data processed in order to provide the service may be stored for a longer period, to enable any disputes relating to the provision of the service to be handled. Data processed for marketing purposes will be kept by the company from the point at which the data subject provides his/her consent until this consent is revoked. In the event that consent is revoked, the data may no longer be processed for the aforementioned marketing and profiling purposes, but may still be stored in order to handle any disputes and/or disagreements and/or to ensure the safety of the customer. The time for which data for marketing and profiling purposes is kept by the company is in compliance with local regulations and with the provisions set out by the Data Protection Authority.

RIGHTS OF THE DATA SUBJECT

Pursuant to art. 13 of the Regulation (EU) 2016/679, we recall that the data subject have the right to request Brumm snc for access to his personal data, their rectification or deletion (where applicable), their portability or the limitation of their processing. The data subject is also entitled to revoke the authorization to process the data to which he consented, as well as the right to lodge a complaint with the Italian Data Protection Authority.
